In comparison to the Chinese authorities, the United
States government in its approach to Internet gambling
is relatively easy-going. Although the United States has
decided on a clear-cut anti-Internet gambling policy and
defined online gambling as illegal, the judicial agencies
have been lenient in its prosecution of offenders.
China is currently taking an aggressive
and decisive approach to stymie all types of gambling whether
it be via the Internet or in mortar and brick
casinos. Chinese authorities are arresting not only casino
managers but players as well. Using the law clause, Article
303 as the basis for their legal attack, Chinese legal enforcers
are becoming stricter than ever in attempting to make people
abide to Article 303’s intentions. According to Article 303,
a person is considered guilty of organized gambling and
will be indicted if he or she is found associated with a
gambling game with stakes higher than fifty thousand yen – in
the region of six thousand dollars – or accepts monetary
payments of five thousand yen – in the region of six
hundred dollars. Heavy fines and up to three
year imprisonment terms are the punishments to be inflicted.
Article 303 also contains group organization violations
in gambling whereby anybody organizing ten or more Chinese
participants for the purpose of gambling and receives a
fee for this work is breaking the law under Article 303.
Internet casino site managers will be indicted in the same
manner as casinos on land. In addition, an accomplice assisting
in organizing any such activity for online gambling will
also be accused accordingly. The people who stand to be
punished in the strictest terms are civil servants caught
operating any form of gambling activity, and those gambling
operators providing services for civil servants or miners
should be really concerned about their punishment.
