“Tennessee Legislation Fails to Address Online Gambling Issues”
While some forms of gambling
are legal in Tennessee – for
instance, participation in charitable events and playing
in the Tennessee lottery – organized gambling is
listed as an illegal activity in the Tennessee
Criminal Code.
However, recent technological
developments have tested Tennessee’s interpretation of which activities are
illegal and which are not. Despite the law’s stipulation
that gambling is “contrary to the public policy of
this state.” it fails to address the scenario of
a Tennessee resident gambling in locations
outside of state jurisdiction. This grey area in the law
has many asking the question of whether internet gambling
is in fact legal or illegal in Tennessee.
Blount County Assistant District
Attorney General Rocky Young is familiar with both sides
of the argument. “I
would imagine the argument that it is not illegal would
be based on the fact that the bet is actually placed in
a jurisdiction where gambling is legal,” says Young.
Young also mentions that participation at online gambling
sites from Tennessee residents is on the increase. However
until the issue is brought to court – and Young states
he is unaware of any legislation currently in the pipeline
seeking to curb internet gambling – gambling fans
can continue their gaming without fear of contravening
Tennessee state law.
