United States District Court Judge To Hear Charges Of iMEGA

iMEGA, the Interactive Media Entertainment & Gaming Association has begun action against  the Unlawful Internet Gambling Enforcement Act. It is reported that they will bring charges against the law to the court of US District Court Judge Mary L. Cooper, which is situated in Trenton, New Jersey. The iMEGA is attempting to bring down the recently passed Unlawful Internet Gambling Enforcement Act in the U.S. based on constitutional grounds.

President Edward Leyden of the iMEGA is reported by the publication Red Herring as saying that their organization believes that the Unlawful Internet Gambling Enforcement Act acts as an infringement of the First and Tenth Amendments of the Constitution in its curtailment of the rights of that organization’s membership. Secondly, President Leyden has indicated the organization’s belief that the U.S. government has exceeded its authority in reference to the ongoing WTO dispute involving Antigua. He says that this too is causing harm to his organization’s members.

iMEGA founder and a former AOL executive Joe Brennan, Jr., has also stated his beliefs to the online gambling information portal Gambling911 when he said that even though the UIGEA can still be enforced prior to the hearing which is to take place on September the 4th, they are confident that the judge will not allow that to happen.

A presiding officer will review the plaintiff’s legal brief during the hearing, that of iMEGA, together with any response of the defendant which is the US Department of Justice and the US Treasury. At that point the judge will most probably decide whether or not to allow the plaintiff's request for a restraining order with regard to the enforcement of the UIGEA. On the other hand, the judge might also order another hearing in which she would listen to the oral arguments and testimonies before she made her ruling.
